Terms and Conditions

1. In these terms and condition:
Perfection  means Perfection Furniture Pty Ltd (ABN 51 110 022 618).
CustomerGoods  means goods which are made to particular specifications provided by the Customer and are not what are commonly known as mass produced goods.
Customer  means any person, firm or company requiring goods from Perfection Furniture.
Goods  means goods or services supplied by Perfection to the Customer and where the context admits includes Custom Goods.

2. These Terms and Conditions shall not be amended, altered or cancelled without confirmation in writing from Perfection.

3.  No agent servant or employee of Perfection has any authority from Perfection to make any warranty or promise in respect of any goods sold pursuant to these terms and conditions without written confirmation from Perfection.

4. Any written quotation or tender provided by Perfection is merely an invitation to the Customer and is valid for (30) days only.

5. Perfection has no obligation to accept any order from the Customer. Each order placed by a Customer must be accepted by Perfection in writing.

6. Unless the Customer has written approval from Perfection, all sales must be paid for in full before despatch of the goods to the Customer.

7. Unless Perfection otherwise agrees, 30% of the price for Custom Goods must be paid prior to the commencement of the production of those goods by Perfection.

8. Ownership, title and property of all goods supplied by Perfection to the Customer remains in Perfection until the Customer has paid all moneys owing in respect of such goods.

9. The customer holds the goods as Perfection's agent and bailee and the Customer owes Perfection a fiduciary duty in relation to the goods until paid for in full in the event that the Customer comes into possession of the goods prior to payment in full for those goods.

10. The risk in the goods passes from Perfection to the Customer when the goods are ready for dispatch to the Customer. It is the Customer's obligation to insure the goods from the moment that the goods are ready for dispatch to the Customer.

11. Any times quoted or invoiced for delivery and/or production are mere estimates and Perfection shall not in any manner whatsoever be held liable to the Customer in the event that such estimates cannot be maintained.

12. Perfection reserves the right to make a reasonable charge for storage if delivery instructions are not provided by the Customer within 14 working days of a request by Perfection.

13. Perfection will not refund any deposit paid by the Customer to Perfection for Custom goods if the Customer cancels the order.

14. Perfection is not obliged to but may at its absolute discretion grant a refund of all or part of the purchase price paid in respect of goods sold, or accept a return of all or some of the goods by the Customer and further may do so (that is, either grant a refund of all or part of the moneys paid for the goods or agree to a return of all or some of the goods) on terms that include but are not limited to the deduction of a restocking and handling fee in favour of Perfection. The normal handling and restocking fee is 30% of the price of the returned Goods or the order amount.

15. Perfection need only accept a return of all or some of the goods if the Customer has inspected the goods and given written notice to Perfection within (2) working days of delivery of the goods to the Customer that the goods do not comply with the relevant specifications or description. Otherwise, the goods shall be deemed to have been accepted by the Customer in good order and condition and no claim for credit, refund, return or repair of the goods shall or need be accepted by Perfection.

16. Perfection's goods are covered by a 12 months warranty for faulty workmanship or manufacturing faults except goods or parts of goods made of timber where such defects are due to the effects of exposure to the elements and/or weather degradation generally.

17. Perfection's warranty becomes null and void in the event of damage to the goods resulting from unauthorized repair, breakage due to misuse, repair, alteration or modification of the goods by anyone other than the authorized representatives of Perfection, or damage resulting from accidents, vandalism, damage during the course of transport to the Customer, acts of nature and/or improper use.

18. Unless the customer supplies it with purchase docket or tax invoice to certify the goods being good order when purchasing, Perfection Furniture is not obliged to repair or replace goods or remedy any failure due to faulty workmanship or materials.

19. Any replacement will be for the failed or damaged parts only, and not of the complete set or suite or the whole order.

20. This warranty given by Perfection Furniture to the Customer does not cover any damage to glasses and the freight for replacement or repair of the goods is to be paid by the Customer.

21. Perfection Furniture reserves the right to make a replacement of goods with similar goods if the design or colours of any of the goods subject to a warranty claim are no longer available.

22. All terms, conditions and warranties implied by law which cannot be excluded, restricted or modified apply to the supply of the goods to the extent required by that law but not otherwise if in conflict with these terms and conditions.

23. Perfection Furniture has no responsibility for any delay or further delay to the supply of goods caused by anything outside of Perfection's reasonable control including but not limited to accidents, strikes, transport difficulties or stock shortages.

24. Failure by Perfection to enforce any of these terms and/or conditions shall not be constructed as a waiver of any of Perfection's rights or of those terms and/or conditions.

25. Any notices given by either party to the other may be delivered personally or sent by facsimile or email or pre-paid mail to the last known address of the addressee and shall be deemed to be received upon posting or receipt of the facsimile transmission or email.
